Terms & Conditions

Hair System Salons

These Terms & Conditions (“Terms”) are a binding agreement between you and Hair System Salons LLC (“Hair System Salons,” “we,” “us,” or “our”) and govern your use of our website at hairsystemsalons.com (the “Site”), our mobile application (the “App”), and our related booking, salon, and communication services (together, the “Services”).

By using the Services — including booking an appointment or creating an account — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

You must be 18 years of age or older and able to form a binding contract to use the Services. By using the Services you represent that you meet these requirements.

The Services

The Site and App let you browse services, book and manage appointments with Hair System Salons, and receive appointment-related and (with your consent) promotional communications. The App and Site are tools for scheduling and communication; the haircare and hair-system services themselves are provided to you in person by Hair System Salons subject to these Terms and our in-salon policies.

Your account

  • Provide accurate, current information and keep it up to date.
  • You are responsible for activity under your account and for keeping access to your email and phone (used for sign-in) secure.
  • One account per person. Do not share your account or impersonate others.
  • We may suspend or terminate accounts that violate these Terms or are used unlawfully.

Appointments, cancellations, and no-shows

  • Reservations may be made by phone, through the Site or App, or in person. Appointment availability is shown in good faith but is not guaranteed until confirmed, and may change due to salon scheduling.
  • We require at least 24 hours’ notice to cancel or reschedule. Late cancellations and no-shows may incur a fee.
  • Deposits, where required to hold an appointment, are non-refundable but may be transferred to a future booking.
  • Results vary from person to person based on individual factors.

Payment, pricing, and refunds

  • Pricing is presented transparently, with no hidden charges. We accept multiple payment methods at the salon.
  • Payment for salon services is collected by the salon at or around the time of service, not within the App or Site. The App does not process payments.
  • Completed hair-system and salon services are non-refundable, consistent with our service guarantee.
  • Products that are unused and unopened may be returned within 14 days of purchase with proof of purchase.
  • Deposits are non-refundable but transferable to future bookings, as described above.

Communications consent

By providing your email and phone number, you agree to receive transactional messages (confirmations, reminders, changes, and account notices) necessary to use the Services. With your separate opt-in, you also agree to receive promotional messages. Your consent to receive promotional messages is not a condition of purchasing any goods or services or of using the Services — you can book and manage appointments without opting in to marketing messages. You can opt out of promotional messages at any time: reply STOP to texts (message frequency varies; message and data rates may apply), or use the unsubscribe link in emails; reply HELP for help with texts. Conduct and confidentiality

  • Services are generally provided one-on-one in private suites. We ask for mutual respect; disruptive, abusive, or unsafe behavior may result in immediate termination of the service.
  • You are responsible for your personal belongings. Hair System Salons is not liable for lost or stolen items.

Cosmetic, non-medical services

Our services are cosmetic and non-medical. We do not diagnose or treat medical conditions, and nothing we provide is medical advice. For medical hair-loss concerns, please consult a qualified healthcare provider. You are responsible for following maintenance guidance; we are not responsible for damage resulting from improper maintenance or the use of third-party products.

Acceptable use

You agree not to:

  • use the Services unlawfully or for any unauthorized purpose;
  • interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or related systems;
  • upload malicious code or content that is unlawful, abusive, or infringing;
  • scrape, reverse engineer, or misuse the Services except as permitted by law.

Intellectual property

All content on the Services — including text, images, logos, branding, and software — is owned by us or our licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App and Site for their intended purpose. All rights not expressly granted are reserved.

If you submit a review, testimonial, comment, or photo, you grant Hair System Salons a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and promotional purposes across media. Do not submit content you do not have the right to share.

Third-party services

The Services rely on third-party providers (for example, our salon-management and scheduling system and message-delivery providers) and may link to third-party apps such as your maps application. We are not responsible for third-party services, and your use of them is governed by their terms.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that appointment slots shown will remain available.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HAIR SYSTEM SALONS LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED USD 100 OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE PRIOR 12 MONTHS, WHICHEVER IS GREATER.

Indemnification

You agree to indemnify and hold harmless Hair System Salons LLC and its affiliates from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services or violation of these Terms.

Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Changes to the Services and Terms

We may modify or discontinue the Services and may update these Terms from time to time. We will post the updated Terms with a new effective date and, where appropriate, notify you. Continued use after changes take effect means you accept the updated Terms.

Termination

You may stop using the Services and request deletion of your account at any time in the App under Account → Personal Info → Delete Account; your account is then permanently deleted after a 14-day grace period, subject to records we must retain by law. We may suspend or terminate access if you violate these Terms or if required by law. Provisions that by their nature should survive termination will survive, including, without limitation, the Intellectual property, Disclaimers, Limitation of liability, Indemnification, and Governing law and dispute resolution sections.

Governing law and dispute resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. We encourage you to contact us first so we can try to resolve any concern directly. Subject to applicable law, the state and federal courts located in Orange County, California will have exclusive jurisdiction over any dispute. You and Hair System Salons agree that disputes will be resolved on an individual basis, and each party waives any right to participate in a class, collective, or representative action.

Apple App Store terms

If you download the App from the Apple App Store, the following apply: these Terms are between you and Hair System Salons LLC only, not Apple; Apple has no obligation to provide support or maintenance for the App; in the event the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund any purchase price (there is currently no purchase price), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the App; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-party list.
